THE ADMINISTRATOR AND USER OF THE WEBSITE
This website is dedicated to both the legal and individual clients interested in our work.
The administrator of the website is MODERN GLASS ART srl., Romanian legal entity, with its headquarters at Cluj-Napoca, Marginasa street, Nr. 52, BL,B, Ap. 1, registered and the Registry of Trade with the nr. J12/2341/2013, with the unique registration code of RO32053216, payer of VAT, hereinafter known as Administrator or Provider. Hereinafter the users of this site will be Users of Clients.

NAVIGATING THE SITE
The access, navigation and the ordering of products off this website constitutes an implied and unconditional agreement on behalf of the user and of wholly accepting and respecting the terms and conditions specified in this document.

RIGHTS OF THE ADMINISTRATOR AND OF THE USER
The administrator of this website has the right to modify every, and any part of this document at any given moment, the structure and content of this website, to interrupt the functioning of the website without previous notice of the users. Users and Clients will have limited access to this document, should they require consulting at any given moment.

INTELLECTUAL PROPERTY
All the content seen on this website is the intellectual property of the Administrator (logo, text, pictures, products etc.) and cannot be used, reproduced, distributed, submitted and displayed without the explicit written permission of the Administrator. The extraction of information for commercial purposes without the permission of the Administrator constitutes a breach of law, copyright and the terms and conditions of this present document.

ACCURACY OF INFORMATION, ERRORS
The Administrator makes his/her best effort to keep the website’s information accurate, up to date and relevant, but the possibility of certain errors exist. Photographs may contain accessories that may not be part of the basic package for the product. The photographs in this virtual shop aim to recreate as best as possible the shipped product, but they have an informative character, and the shipped products may differ in terms of transparency, color, texture due to personal setting of each client’s monitor, resolution and type. On the other hand, all stained glass products are manually created works of art, their colors are chosen by the artists in terms of representation needed – but it is impossible to reproduce a design perfectly in this manner. The contents of this site do not represent a legal obligation whatsoever.

USER ACCOUNTS
Certain information and sections of the site necessitate the creation of a user account. The responsibility for the accuracy of the information given and every action performed with the account wholly rests with the Client creating the account. The possibility of creating an account is given only to active legal or individual entities. The Administrator has the right to deactivate or not to validate a user’s account.

SECURITY OF PERSONAL DETAILS
Conforming with the nr. 677/2001 law, to protect personal privacy in processing personal information and the free flow of said information, modified and completed in the nr. 506/2004 law regarding the processing of personal information and the protection of private lives in the electronic telecommunication sector, our website is bound to administer such rights in safe conditions and only for specific goals the details it collects from you. The role of collection personal details is only for using them in issuing the invoice for the ordered products. Failure to communicate the necessary information for invoicing the products will result in the termination of the order. The aim of collecting personal information is to help the provider carry out the orders and are confidential between them and the Client. According to the 677/2001 law, you have the right to acces, change, to not be submitted to individual decisions and to call upon legal help. Also, you can oppose the processing of personal information and require their deletion afterwards. PRICES
Our prices are in Euro and do not contain VAT. For all commercial transactions and invoicing, prices will be equated in Ron on the momentary exchange rate at the moment of invoicing at BNR. There is a 24% added VAT. The prices are adapted to the dimensions and charcter of the specific product as they are seen in the virtual shop. For personalized products or ones with differing dimensions and characteristics to the ones presented in the shop the price will be recalculated based on the personal dimensions and added details chosen. For these personalized details (differing dimension, differing color, ultraclear, laminated, securized or thermopane glass etc.) the new price will be communicated through the ORDER CONFIRMATION followed by the PROFORMA INVOICE. The Administrator acknowledges that the prices show non the website may not be the real ones due to an error or other disfunctionality. The prices may ba modified without previous acknowledgement, warning or notice.

ORDERING
CLIENTS, USERS can place orders by phone, through e-mail, fax or directly from the site by adding items to your basket. Each order will be confirmed by the producer through the ORDER CONIRMATION form which will contain the availability of the product desired, terms of execution and delivery estimates and will be followed by the PROFORM INVOICE. By finalizing the order the CLIENT consents that the PRODUCER may contact them by phone or e-mail and that the ORDER constitutes agreement with the “General terms and conditions of delivery”. Failure to take notice of said document does not does not exonerates the CLIENT of any responsibility. “General terms and conditions of delivery” can be found on the website, or on demand of any CLIENT.

THE PRODUCER may CANCEL an ORDER after various notifications to the CLIENT, without any further obligation, without any party being liable to any claim of interest expense if:

  • - The data transmitted by the CLIENT is incomplete or inaccurate
  • - If the CLIENT does not fulfill his/her obligation to pay the PRODUCER within the terms and conditions stabilized beforehand
  • - If the identification details of of the ordered product are incomplete (missing nr., name, dimensions, colors)

The CONTRACT between PRODUCER and CLIENT is considered closed at the moment the CLIENT receives it from the PRODUCER, through the medium of e-mail the ORDER CONFIRMATION and PROFORMA INVOICE. An ORDER that remains unconfirmed by the PRODUCER has no legal standing. The notification right after placing an ORDER has but an informing role and does not constitute the confirmation of the ORDER. This notification is done via phone or e-mail.

PERSONALIZED PRODUCT
The models presented here are artistic creations developed for visualizing and presenting a possibility for our CLIENTS to individualize the chosen products. We understand “individualizing” in the following manner:

  • 1. adapting the design to the dimensions desired by the CLIENT (all presented models of painted, sandblasted glass and all variations of stained glass panes for doors, windows and shower panes)
  • 2. our glass products can be painted in PANTONE and RAL color schemes
  • 3. after choosing the stained glass model we offer 3 color variants projected by our artists within the color schemes preferred by the CLIENT to choose the scheme that comforts them the most.
Adapting the design to the preferred dimensions and colors of the CLIENT or the execution of the 3 variations of stained glass colors ARE INCLUDED IN THE PRICE but their execution only takes place after the CLIENT has paid for the PRO FORMA INVOICE and the sum has entered the PROVIDER’s bank account.

PAYMENT
Payment is considered valid when the PROVIDER is able to effectively cash it in from its bank account via cash or transaction. The execution or delivery term starts from the date the entire sum is transacted to the PROVIDER’s account. The fiscal document issued by the CLIENT does not put the product in his possession, but only when the PROVIDER is able to cash in the value of said fiscal document. Failure to issue payment in time by the CLIENT will draw after itself a penalty of 0,2%/day, all the while keeping the ordered product at the PROVIDER, or for further delays: taking legal action. The CLIENT may only issue payment based on the PROFORMA INVOICE or the FISCAL INVOICE issued by the PROVIDER.

DELIVERY
Delivery is different for stock and individualized, on demand products. Products on stock are available immediately and can be delivered in 2 days maximum from the moment of ORDER CONFIRMATION. For individualized and on demand products the CLIENT will receive an ORDER CONFIRMATION that will contain the shipping and delivery details. In the case of on demand individualized products the delivery time starts to roll from the moment the PROVIDER is able to cash in the payment or advance from his account. All products can be delivered door-to-door via courier.
The CLIENT is advised to examine the product in front of the delegates of the PROVIDER, the courier or transporter. Any intimation regarding any broken, scratched or deteriorated product must be reported at this moment before signing the papers of handover, otherwise no later complaints are taken into consideration, the products being under the risk management of the CLIENT directly after signing the aforementioned papers. In case the PRODUCER is unable to execute the desired product, the CLIENT will be notified. The PRODUCER will only ship a similar design of the same price only after notifying the CLIENT to which this latter has given approval, otherwise if the CLIENT refuses the similar design, the PRODUCER can relinquish the standing contract without any further obligation and claims of damage to interests. The PRODUCER’s responsibility is limited to compensating for the price of the ordered and paid products.

OBJECTIONS, RETURN POLICY
Objections regarding products with damages and defects stemming from execution processes may be communicated towards the PRODUCER within 72 hours from receiving the product. Failure to communicate them may end in the termination of any warranty. In case it is agreed upon that the products are defected from execution the PRODUCER may replace said products or return their price in full. The return of stock products is done within ten standard days from the moment of receiving the product with the condition that it not be further damaged and in the original packaging. There is no return policy and no returning on demand and individualized products! The return costs and courier costs will be handled by the CLIENT. SOLICITING SAMPLES
The CLIENT has the possibility to create samples of the ordered product (ultraclear, sandblasted, painted or stained glass samples). Samples are free of charge. The 25 RON (VAT included) shipment cost for the delivery of the samples will be handled by the CLIENT and will be charged upon arrival. The sample is a 10 by 10 or 20 by 20 cm for glass and 2 by 2 cm for color palettes. The CLIENT may solicit 1 or 2 samples per delivery. Please feel free to use the contact sheet for your soliciting.

MOUNTING, HARDWARE
Our firm does not execute any mounting and no hardware is included in our products’ prices.

PACKAGING
Our products are packaged with standard fit for transport methods and the price of packaging is included in the price of the product itself. Although for products larger than 2,4 by 0,9 the packaging and transport will be handled individually in each case depending ont he function and specifications of the product and may include additional costs. Products exceeding a certain dimension cannot be packaged and may only be transported on vehicles specifically designed for the transportation of glass.

WARRANTY
Every product is covered by a warranty in case of designing, manufacturing and/or hidden errors. All our shipped products are accompanied by a “Declaration of Conformity/Certificate of Warranty”. Warranty does not cross the national border and is conform to the norms and legislation in effect at the moment of issue.
